1. About these terms

These Website Terms of Use apply when you access or use https://v02.dev and any public webpage operated by v02 Studio.

v02 Studio is operated by Nelson Ngo, ABN 68 264 322 144, in Victoria, Australia. In these terms, “v02,” “we,” “us” and “our” refer to that business.

By using the website, you agree to these terms. If you do not agree, please stop using the website.

2. Website information only

The website provides general information about v02, its services, selected work, ideas and approach. It does not provide legal, financial or other regulated professional advice.

Information on the website is not a binding quote, offer or promise to provide services. Any scope, timing, fee or deliverable shown on the website is indicative unless confirmed in a separate written agreement.

You should assess whether the information is suitable for your circumstances and obtain appropriate professional advice where needed.

3. No client relationship through website use

Viewing the website, sending an enquiry, requesting a website review or booking a call does not create a client, agency, fiduciary or other professional relationship.

v02 is not required to accept an enquiry or commence work. A client relationship begins only when the parties enter a separate written agreement or otherwise clearly agree in writing to the services, scope and fees.

Paid web design, development, SEO, consulting and related work will be governed by the applicable proposal and client services agreement. If those documents conflict with these Website Terms of Use in relation to paid services, the client agreement will prevail.

4. Portfolio work, results and testimonials

Portfolio examples, case studies, performance figures, search rankings, testimonials and client outcomes describe particular work in its original context and at the date stated.

They do not guarantee that another project will achieve the same result. Website, commercial and search performance can be affected by the client's market, competition, domain history, budget, content, implementation, ongoing activity and changes made by third parties, including search engines.

We aim to keep published case studies accurate and to provide context for material claims. Historical figures may change after publication and should be read with the date, source and methodology stated on the relevant page.

5. Intellectual property

Unless otherwise stated, v02 owns or is licensed to use the website's design, code, written content, graphics, branding, photographs, videos and other material.

Client names, logos, screenshots, testimonials and other client materials remain the property of their respective owners and are displayed for portfolio or attribution purposes with the relevant permission or other lawful basis.

You may view the website and make a temporary copy through your browser for personal or internal business evaluation. You must not, without prior written permission:

  • reproduce, republish, sell or commercially exploit substantial website content;
  • copy or present v02's portfolio work as your own;
  • remove copyright, trade mark or attribution notices;
  • scrape the website at a volume that disrupts or unreasonably burdens it; or
  • reverse engineer or reuse website code except to the extent that applicable law permits that right and does not allow it to be excluded.

Nothing in these terms transfers intellectual property rights to you.

6. Permitted use

You must not use the website:

  • unlawfully, fraudulently or in a way that infringes another person's rights;
  • to introduce malware, malicious code or harmful material;
  • to probe, bypass or interfere with security, access controls or availability;
  • to send automated spam or abusive submissions;
  • to impersonate another person or misrepresent your authority; or
  • in a way that damages, disables or places an unreasonable load on the website or its providers.

We may restrict access, block requests or take other reasonable protective action where we suspect misuse or a security threat.

7. Information you submit

You retain ownership of information and material you submit through an enquiry, email or booking process.

You give v02 permission to use, reproduce and communicate that material only as reasonably necessary to review and respond to the enquiry, prepare a proposal, deliver requested services, maintain business records or comply with law.

You must not submit material that is unlawful, malicious or infringes another person's rights. If you provide confidential information or personal information about another person, you must be authorised to do so.

Do not submit passwords, private keys, payment-card details, government identifiers, health information or other highly sensitive information through the general contact form.

8. Third-party services and links

The website may link to or use third-party services, including Calendly, social networks, hosting services and client websites.

Third-party sites are operated independently and may have their own terms, fees, availability and privacy practices. A link does not mean v02 controls or guarantees that service. You use third-party sites at your own discretion and should review their applicable terms and policies.

9. Website availability and security

We try to keep the website accurate, available and secure. However, websites and internet services can experience interruptions, errors, delays and security events.

To the extent permitted by law, we do not promise that the website will always be available, uninterrupted, error-free or free from harmful components. We may change, suspend or withdraw any part of the public website where reasonably necessary.

You are responsible for maintaining appropriate security and backups on the device you use to access the website.

10. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy under the Australian Consumer Law or another law where it would be unlawful to do so.

Where a guarantee, right or remedy cannot lawfully be excluded, these terms apply subject to that guarantee, right or remedy.

11. Liability for website use

To the maximum extent permitted by law, v02 is not liable for loss arising solely from:

  • reliance on general information on the public website without obtaining advice appropriate to your circumstances;
  • the temporary unavailability of the website;
  • a third-party website, service or resource; or
  • use of the website in breach of these terms.

This limitation does not apply to liability that cannot legally be excluded or limited, including any applicable rights under the Australian Consumer Law. It also does not alter the rights or obligations in a separate client services agreement.

12. Privacy

Our Privacy Policy explains how we handle personal information connected with the website and business enquiries. By submitting information, you acknowledge that it will be handled as described in that policy and any collection notice displayed at the point of collection.

13. Changes to the website and these terms

We may update the website and these terms from time to time. The current version will be published with its effective and last-updated dates.

Changes apply prospectively from the stated effective date. If you do not agree with an updated version, you should stop using the website.

14. Governing law

These terms are governed by the laws of Victoria, Australia. You and v02 submit to the courts of Victoria and courts entitled to hear appeals from them, subject to any rights you have to bring a proceeding elsewhere under a law that cannot be excluded.

15. Severability

If a provision of these terms is found to be invalid or unenforceable, it will be read down to the extent necessary or severed. The remaining provisions will continue to apply.
